CHINESE ASSAULTED. ATTACK BY COUNTRYMAN. GREY'S AVENUE FRACAS. Conflicting stories about a fracas which occurred last night in a Chinese restaurant in Grey's Avenue were told by the two participants in the Police Court this morning, when Dudley ,On, alias Chan thingy, aged 36, was charged with assaulting Chan Fun. Both Chinese, who each gave evidence, spoke through interpreters. For On, Mr. Aekins t ntered a plea of not guilty. Chan Fun declared that at 7.45 last evening, while he was in a cafe, accused called him over to speak to him. On then - struck him over the left eye, knocking him out. • Witness could not remember whether he were kicked, but this morning his chest and nose were sore. Complainant denied that he had ever alleged to the police that accused was a dealer in opium. He was in ill-health and for this reason he was being sent back to China at his relatives and friends' expense. "When he called at the detective office, complainant was covered with blood," said Detective Brady. He was bleeding from the nose and a cut over the left eye. When accused was arrested and to the detective office he made a statement in which he declared that he had asked Chan Fun for money the latter owed him. A quarrel followed and then there was a fight. "The fight was between him and me; there was 110 one else in it," continued the statement. "I hit the first blow. He owes me £S0 &nd I wanted to get it before he goes/back to China." To Mr. Aekins the detective said that accused knew English, while another Chinese who spoke English was present with him when the statement was taken. 111 evidence accused said that he had asked complainant to return the money he owed him. "I understand lie has plenty of money; he has won a good deal at the races," continued accused. "He denied owing me the money. I showed him a letter which showed he owed me the money. Then he lost his temper and struck me." Accused added that wlien he gave the statement he had not understood it, as he did not understand English. Senior Detective Hall: You cannot understand English ? Accused (through an interpreter): I can understand it half and half. "I am satisfied that the assault took place the way Chan Fun described it," said Mr. W. R. McKean, S.M. Accused knew the meaning of some questions I put to him and he knew quite well the meaning of the statement. This is an assault which was entirely unprovoked and accused has aggravated it by the story he has told." On was fined £4 and ordered to pay costs totalling £1 15/6, in default 14 days' imprisonment.
