With the patient resignation of his race a 52-year-old Chinese of good appearance stood in the dock of the Police Court yesterday while it was' debated whether or not he should be deported—which to him meant wandering the world on ships, a man without a country. He was Chan Sim, or Gin Hing, a carpenter, and he faced three charges (1) ship desertion, (2) being a prohibited immigrant, and (3) with a breach of the Aliens' Regulations. His story, as told by Senior-Sergeant Joyce and his counsel, Mr. A. H.': Wihstone, was that Chan Sim, who Was born in Singapore and had never been to China, had deserted a Dutch oil-tanker in New Zealand in September, 1934. He went to the South Island and worked in the market garden of Yee Wah Sue. at Timaru. When Yee Wah Sue died in 1937 Chan Sim inherited the garden and Yee's papers. Later he came north to Ohakune and there he presented himself for registration as an alien, showing the poll tax papers of Yee Wah Sue as evidence of his identity. He was told- that they would be investigated, but had left Ohakune when he was later wanted. He came to Auckland, lived within two doors of a police station, and secured work, under the name of Chan Sim, Mr. Anercrombie, of the Customs Department, was in Court to state that the full facts of the case had been presented to the Minister concerned," and that it was requested that an order--be made for Chan Sim's deportation. Mr. Winstone argued that, as accused was born in Singapore he had -no country to which he could be deported. After reading the section of the Act dealing- with such cases, Mr.. J. H. Luxford declared that he did not read-, the seGtion as making it obligatory for a deportation order to be made. I cannot see any good reason toi making a deportation order,' he said. On the first charge Ghan Sim was convicted and fined £20; on each of the others he was convicted and discharged.
