WELLINGTON, January 31 A decision was given by Mr Martin R.M 'to-day in a case in which the Corporation Inspector had summoned a Chinese fruiterer for selling rotten fruit. Hie Worship said he was unable to distinguish the present case from that cited by counsel for the defendant, in which Sir Justice Stephen had held that there must be seizure of the article exposod for sale then it must be condemned by a Justice, when the person who exposed the article would be liable to a penalty. In this ease the fruit was seized after it had been purchased, therefore there was no offence according to the law, and the information most be dismissed.
