Theratening Behaviour.—A Chinaman named Lin Foon, on whose behalf Mr B. S. Irwin appeared, was charged with using threatening behaviour on the City road, Roslyn, on Friday afternoon, with intent to provoke a breach of the peace. Defendant was in addition charged with assaulting Constable Monro.—The constable stated in evidence that an the day stated he was on plain clothes duty in Roslyn, and observed the defendant wheeling a fish conveyance on the footpath. Witness ordered Foon to desist from using the footway, informing him that he was & constable. Accused refused, whereupon witness proceeded to tako his name and address. To the latter query (Foon answered that he lived in heaven. Witness was about to shift the barrow when he was approached by the Chinaman, who handled a chopper and excitedly acclaimed: "I kill you." Witness succeeded momentarily- in calming accused who again picked tip his dangerous instnv nen J obviate further trouble witness handcuffed Foon.—Counsel for lie defendant pleaded that the assault was purely of a technical character, as his client did not comprehend the meaning of the word "constable."—His Worship said he quite approbated that contention, and had the defendant any absolute intention of using the chopper he could possibly have done so. On the first count he would enter a conviction, and order the amount of the expenses (6s to be paid, while accused would be can and discharged on the second. CITY POLICE COURT.
